1. General Terms and Scope 1.1 These Terms of Service (hereinafter "ToS") apply to all contracts concluded between the operator of the Shop (hereinafter "Provider") and its customers (hereinafter "User"). 1.2 Deviating terms and conditions of the User shall not be recognized unless the Provider expressly agrees to their validity in writing. 1.3 These ToS also apply to future business relationships without requiring further notice. 2. Subject Matter of the Contract 2.1 The Provider sells alternative Minecraft accounts (hereinafter "Alt-Accounts") to Users. 2.2 The Provider does not guarantee that the sold Alt-Accounts will function for a specific period or have particular characteristics unless expressly stated. 2.3 The Provider reserves the right to change, expand, or restrict the offering at any time. 3. Account Replacement Policy 3.1 If an Account does not work at the time of delivery, the Provider will replace it with a new account free of charge. 3.2 To qualify for replacement, Users must report non-working accounts within 12 hours of purchase by providing proof that the account credentials do not work as provided. 3.3 Replacement is limited to accounts that do not work at the time of delivery. The Provider does not replace accounts that stop working after successful initial login. 3.4 The Provider reserves the right to verify all replacement claims before issuing a replacement account. 3.5 This replacement policy applies only to login functionality and does not cover other account characteristics unless specifically guaranteed at the time of purchase. 4. Contract Formation 4.1 The presentation of Alt-Accounts in the online shop does not constitute a legally binding offer but rather an invitation for the User to place an order. 4.2 By clicking the "Purchase" button or a similar button, the User submits a binding offer to purchase the selected Alt-Account(s). 4.3 The contract is formed when the Provider confirms the order or delivers the Alt-Account credentials to the User. 5. Prices and Payment 5.1 All prices shown are final prices and include applicable statutory taxes. 5.2 Payment is due immediately upon order placement. 5.3 The Provider accepts payment methods as shown on the website. 5.4 All transactions are final. No refunds will be issued after account credentials have been delivered, except as specified in the Account Replacement Policy. 6. Delivery and Transfer of Risk 6.1 Delivery of Alt-Account credentials occurs immediately after payment confirmation, typically through digital delivery (email, dashboard, or download). 6.2 The risk of accidental loss or degradation of the Alt-Account transfers to the User upon delivery of the account credentials. 7. User Obligations 7.1 The User agrees to: - Keep account credentials confidential - Not share or resell purchased accounts without prior written permission - Use the accounts in compliance with Minecraft's End User License Agreement - Not use purchased accounts for illegal activities, harassment, or cheating in a manner that violates server rules 7.2 The User acknowledges that the Provider bears no responsibility for any changes made to the account after delivery. 8. Limitation of Liability 8.1 The Provider shall be liable without limitation for damages resulting from injury to life, body, or health. 8.2 For other damages, the Provider shall only be liable in cases of intent or gross negligence. 8.3 The Provider assumes no liability if Alt-Accounts become invalid due to actions by Mojang/Microsoft or due to changes in password or other account details by third parties. 8.4 The Provider's liability is limited to the purchase price of the affected Alt-Account. 9. No Warranty on Account Longevity 9.1 The Provider offers no warranty regarding how long an Alt-Account will remain functional or undetected by Mojang/Microsoft. 9.2 The User acknowledges that the purchase of Alt-Accounts involves inherent risks, including the possibility of the account being banned or reclaimed. 10. Intellectual Property 10.1 The User acknowledges that all intellectual property related to Minecraft belongs to Mojang AB and/or Microsoft Corporation. 10.2 This service is not affiliated with, endorsed by, or sponsored by Mojang AB or Microsoft Corporation. 11. Privacy and Data Protection 11.1 The Provider processes personal data in accordance with applicable data protection laws. 11.2 User data will only be collected, stored, and processed to the extent necessary for providing the service. 11.3 Payment data is processed by the respective payment provider according to their privacy policies. 12. Applicable Law and Jurisdiction 12.1 These ToS and all legal relationships between the Provider and the User shall be governed by the laws of the United States, excluding the UN Convention on Contracts for the International Sale of Goods. 12.2 If the User is a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be the Provider's registered office. 13. Severability Clause 13.1 Should individual provisions of these ToS be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. 13.2 The parties undertake to replace invalid or unenforceable provisions with valid provisions that come closest to the economic purpose of the invalid provision. 14. Amendments to the Terms of Service 14.1 The Provider reserves the right to modify these ToS at any time. 14.2 The User will be notified of amendments.
